This can sometimes cause confusion for landowners who are familiar with county commissioners and may feel comfortable with them hearing their case.
It’s crucial for landowners to carefully review the appointees and discuss with their attorney whether they want to strike one of the special commissioners. You have the option to strike one commissioner for no reason whatsoever, but it’s important to do so within the timeframe provided by the law. From the date they’re appointed, you have 10 days to strike a special commissioner for no reason. The condemnor also has the right to strike one commissioner.
There Is Also a Possibility of Striking a Special Commissioner for Cause
It’s also worth noting that there is a possibility of striking a special commissioner for cause, such as if there is a good reason to believe that they have a relationship with the condemnor or are an employee of the condemnor. This doesn’t happen very often, but it’s important to be aware of this option.
Dates Are Important in Step 6
One thing to keep in mind is that the date of the appointment of the special commissioners is not as important as the date you receive notice of it or your attorney receives notice of it.
