Summary of the TxDOT FM 236 Widening Project Video
Hello, I’m Phil Hundl here with a project alert regarding TxDOT’s FM 236 Expansion Project. TxDOT’s right of way acquisition company, TNP, is starting to contact landowners regarding the FM 236 widening. If you are a landowner in with land adjacent to the road, you may have already been contacted.
The FM 236 Widening Project runs from the US 77 loop northwest out to FM 237. It’s a road expansion. If you own land on either side of the existing FM 236, you could be affected by this project if your property is between FM 237 and US 77.
TxDOT Is Contacting Affected Property Owners
Landowners are currently being contacted about this project. Yes, there have been public meetings and notices, some possibly years ago. Now things are becoming active as far as directly contacting landowners and beginning to acquire the strips along the highway that TxDOT wants to acquire.
First, they’re going to try to negotiate and acquire property along FM 236 by negotiation. Their offered compensation levels are normally low, and then they’ll proceed with filing condemnation suits.
The first step involves TNP’s right of way acquisition team, one of whom I believe is Shannon Perkins, sending out letters and questionnaires to landowners.
At This Stage You’re Not Required to Provide Any Information
At this stage in the condemnation process, you are not required to provide them with any information. If the case progresses into condemnation and litigation, there will be a time when you will be required to provide information, just as they are required to provide you with information.
You Should Speak with an Attorney to Help Protect Your Rights
It’s important that you’re familiar with this process, and aware of their obligations and your rights. I strongly recommend speaking with an attorney who handles condemnation for landowners so that your attorney can help you understand the process, your rights, and the obligations of the condemner.
I hope you find this information helpful. Once again, this is regarding the FM 236 TxDOT Expansion Project in Victoria County.
