– – Hello, my name is Philip Hundl. I’m an attorney with the law firm of Wadler, Perches, Hundl & Kerlick, with our principal office in Wharton County, with offices also in Fort Bend County. My primary focus is condemnation cases, representing landowners.

I’d like to talk a little bit about a current condemnation project by Kinder Morgan. It’s been referenced or it’s referred to as the Permian Highway Project, or PHP.

I want to talk a little bit about the Permian Highway Project for those of you who have been contacted by Kinder Morgan or their right of way agents regarding this project.

This project is a joint venture, like many of these projects are, between Kinder Morgan and EagleClaw Midstream Ventures. This project, it’s a natural gas pipeline, a 42-inch diameter pipeline. It runs approximately 430 miles, from Waha, Texas, which is southwest of Midland, to Katy, Texas, so it’s going to cover about 13 to 14, 15 counties in Texas. My focus has been primarily on the counties of Hays County, Caldwell, Lavaca, Colorado County, and also Bastrop County.

The right of way agents are beginning to do the preliminary due diligence for the civil and environment surveying that started in September, more or less, 2018. That will continue through next year, May, June, July, in the summer, and they expect or hope to begin construction more or less fall of 2019. The proposed in-service date they believe is the fourth quarter of 2020.

So I know that sounds like a long time away. However, as you know in these pipeline projects, the process of beginning the condemnation process by the pipeline companies will begin once their survey and environmental studies are done. I have a map of the project on my website to keep in mind.

You know, who are some of the original shippers that will be using this pipeline, the Permian Highway Project pipeline?  It’s been disclosed that EagleClaw, is one of the initial partners with Kinder Morgan — Kinder Morgan has 50% stake and EagleClaw has the other 50% with I believe Apache having an option to acquire some equity stake in the pipeline. The other shippers are, at least for now, Apache and XTO, which is a subsidiary of ExxonMobil.

Hopefully this information is helpful. Once again, as always, and you can refer to my section on right of way agents and things to be aware of. If you’re approached by a right of way agent listen to what they have to say, review the information they provide. However, I don’t recommend you entering into any easements or agreements without consulting an attorney who’s familiar with landowner representations in condemnation cases.
