Summary of Step 7 of the Texas Land Condemnation Process Timeline
Hi, it’s Phil Hundl again. In this continuation of our video series on condemnation proceedings, we’re now at Step 7, which is all about scheduling the Special Commissioner’s hearing. Once the petition has been filed and the Special Commissioners have been appointed, the next step is for the condemnor to notice the Special Commissioner’s hearing. This hearing will be scheduled 20 days after the notice is given.
Notify Your Attorneys of Your Availability for the Special Commissioners’ Hearing During Step 7
As a landowner, it’s essential that you notify your attorney of any upcoming vacation plans or medical appointments that may impact your availability during this time. You’ll want to make sure that you’re present at the hearing, so it’s crucial to let your lawyer know when you’ll be available.
The hearing itself will either be in person or via Zoom, depending on the condemnor and your preference. It’s important to let your attorney know which format you prefer. Once both sides have communicated their availability, they’ll work with the court to come up with a date that works for everyone. As a lawyer, I always ask the opposing side to confer with me before unilaterally setting the Special Commissioner’s hearing. This way, I can confer with my client and ensure that we’re available on the proposed date.
The Condemnor May Try to Set the Hearing Unilaterally
It’s worth noting that the condemnor may try to set the hearing unilaterally without conferring with you or your lawyer. That’s why it’s essential to have an experienced lawyer on your side to protect your rights and ensure that you’re not taken advantage of during this process. You have the right to be present at the Special Commissioner’s hearing and to have a say in the scheduling of the hearing.
In conclusion, Step 7 is all about setting and scheduling the Special Commissioner’s hearing. As a landowner, it’s critical to let your attorney know of any upcoming scheduling conflicts so that your lawyer can work with the condemnor’s lawyer to find a suitable date for everyone.
