As reported at Oilprice.com, the judge ruled that the Texas Railroad Commission doesn’t have to approve the Permian Highway route. That ruling by Judge Lora Livingston allows Kinder Morgan to take the land it needs for the project using the power of eminent domain and the condemnation process. She said the court could find no authority for the proposition that the legislature had granted the Railroad Commission that right to approve or disapprove the Permian Highway route.
The case had been brought by a group of landowners and state officials who were trying to block the Permian Highway Pipeline project.
