Summary of Step 12 of the Texas Land Condemnation Process
Hi, Phil Hundl here, wrapping up our series on the condemnation timeline steps. This 12-step condemnation timeline aims to help landowners better understand the condemnation process and identify where they are in the proceedings.
We’ve now reached Step 12, where one or both parties have objected to the award, and the case moves into the civil litigation process. The earlier stages, from the petition filing to the Special Commissioner’s hearing, are known as the administrative phase. After an objection is filed, the case enters the normal civil litigation process, which may ultimately end in a trial if not resolved by the parties.
At Step 12 the Case Enters the Normal Civil Litigation Process
Civil litigation entails conducting discovery, which involves both sides engaging in written discovery, property inspections, and depositions. Written discovery includes requests for production, interrogatories, requests for admission, and initial disclosures. Pretrial motions may be filed to address specific issues that one side or the other wants the court to declare or determine.
Both parties will disclose their experts, who may be challenged or have their opinions contested. During the litigation phase, courts often send parties to mediation in an attempt to resolve the case before trial. If mediation is unsuccessful, pretrial hearings are held to resolve disputes over evidence and determine trial logistics, such as scheduling and technology use.
If the case isn’t resolved before trial, it will proceed to that stage. After a trial, there may be further stages such as motions for a new trial or appeals to higher courts, but we won’t cover those in this video.
